Cancellation policy
You have the right to cancel this contract within fourteen days without giving any reason, in accordance with the cancellation policy. The revocation period is 14 days from the day on which you ordered a blood collection set or an order form for the SALOMED Test. The right of withdrawal granted therefore automatically expires 14 days after the order has been placed or earlier when the blood sample is sent to a SALOMED partner lab or the blood sample is taken in a SALOMED partner lab even if this occurs before the expiry of the 14-day withdrawal period. However, the right of withdrawal expires at the latest 14 days after the paid order even if the blood sample has not yet been sent to a SALOMED partner lab or taken in a SALOMED partner lab. and inform the contractor by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You may use the enclosed model withdrawal form for this purpose, which is, however, not mandatory. In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of revocation according to the revocation instruction
If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. If the goods are returned freight collect, we are entitled to retain or invoice a corresponding amount. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
Exclusion of the right of withdrawal/right of revocation
Pursuant to § 18 FAGG, the consumer has no right of withdrawal/right of revocation in the case of distance or off-premises contracts as soon as the blood analyses have been transmitted to "SALOMED". The right of withdrawal granted here therefore expires at the latest upon receipt of the blood analyses by a partner laboratory of "SALOMED", even if this occurs before the expiry of the 14-day withdrawal period.
